Are Escorts Legal in Spain? What International Clients Should Know
In short

Are escorts legal in Spain? Meeting a consenting adult companion in private is not a crime, while exploitation, minors and street solicitation are clearly forbidden. Here is what international clients should know about escort laws in Spain and how to book safely and discreetly.

One of the first questions international clients ask us is a simple one: are escorts legal in Spain? It is a fair question. Laws on adult companionship differ a great deal across Europe, and what is normal in one country can be an offence in the next. This guide explains, in plain language, how escort laws in Spain work today, what is clearly illegal, where the political debate stands and how to book a high class escort in Spain safely and discreetly as an international client.

Please note: this article is general information for international clients, written by an agency and not by a lawyer. It is not legal advice. Laws and local rules can change, so if you need certainty about your own situation, speak to a Spanish lawyer.

Spain does not ban adult sex work as such. Since the reform of the Criminal Code in 1995, the private exchange of time and intimacy between two consenting adults is not a crime, and booking an adult companion is not an offence for the client either. Spanish law neither regulates nor prohibits it. Commentators often describe the situation as a grey zone: tolerated, but not recognised as a profession.

For an international client this means that meeting an adult escort in a hotel or a private residence, where both of you have agreed freely, is not against Spanish criminal law. What the law targets is everything around it that involves pressure, exploitation or minors.

02What Spanish law clearly forbids

The Spanish Criminal Code is strict about exploitation. These are the lines that matter:

  • Coercion and exploitation. Forcing or pushing an adult into sex work through violence, intimidation, deception or abuse of a situation of need or vulnerability is a crime punished with prison sentences. Profiting from someone’s sex work under such conditions is punished in the same way.
  • Minors. Anything involving a person under 18 is a serious crime, without exception and regardless of what that person says about their age.
  • Human trafficking. Trafficking for sexual exploitation is one of the most heavily punished offences in Spanish law.

The common thread is consent and freedom. An arrangement between adults who choose it is treated very differently from one where someone is under pressure. A serious agency exists precisely to make sure that the ladies it represents are verified adults who decide freely which dates they accept.

03Public places: the street is a different matter

Where clients can run into trouble is not in a hotel but on the street. Spain’s 2015 public security law treats requesting or accepting paid sexual services in public areas near places used by minors, such as schools and playgrounds, or where it could put road safety at risk, as a serious administrative offence. Fines in this category can reach up to 30,000 €.

On top of the national rule, many cities have their own civic ordinances. Barcelona has prohibited street solicitation in public space since 2012. Madrid introduced fines of up to 3,000 € for clients who approach street sex workers, and other cities, including Palma, have adopted similar bans. These rules are local and they change, but the message for clients is consistent: do not look for company on the street. It is not only a legal risk, it is also the least safe and least discreet way to meet anyone.

04The political debate: is the law about to change?

Spain has discussed tougher rules for years. Some parties want an abolitionist model that would also make paying for sex an offence, as in Sweden or France. In May 2024 the Spanish parliament rejected a bill that would have made any brokering of sexual services a criminal offence and introduced fines for clients. It was one of several reform attempts that have failed in recent years.

The debate has not disappeared, but it has paused. A broader abolitionist law was not included in the government’s legislative plan for 2026, and a new law against human trafficking was still being prepared when the government called an early general election for 29 November 2026. With parliament dissolved, neither text can be passed before a new parliament is formed, so the topic may return after the election. As of November 2026, the legal situation described above still applies. If this changes, we will update this article.

05What this means for you as a client

In practice, the legal questions for an international client come down to three things. Is the lady an adult who has chosen this freely? Is the meeting private rather than on the street? And is the person you are dealing with honest about prices and conditions? If the answer to all three is yes, you are on safe ground. Most problems clients run into are not legal ones at all, but scams, misunderstandings about money or a lack of discretion, and all of these are avoidable with a little care.

06Escort or prostitute: why the difference matters

An escort agency like One Kind arranges companionship. Our clients book a lady’s time and presence for a dinner, an evening, a night or a journey. Our terms and conditions say it clearly: all fees exclusively cover the companion’s time and presence, and any form of intimacy is subject to mutual consent and the companion’s individual discretion at all times. Nothing is promised, nothing is owed, and each lady decides for herself.

We explain the difference between the two in more detail in our article escort vs prostitute. For clients the practical point is this: a professional escort agency in Spain works with verified adults, written conditions and a clear booking process, which protects both you and the lady.

07How a serious escort agency in Spain works

Because the market is unregulated, the quality of agencies varies widely. This is what a legal and serious escort service in Spain looks like in practice:

  • Verified ladies. The agency knows every lady personally, has checked her identity and uses recent, genuine photos.
  • Free choice. Each lady chooses her dates and her preferences. A good agency will tell you honestly if a wish is not for her.
  • Clear prices. Rates are published before you book. At One Kind a two hour date starts from 600 €, and all formats are listed on our rates page.
  • Transparent deposit. Your date is confirmed once the security deposit of at least 40% has reached us. Until then we cannot confirm the date to the lady, and she cannot reserve her time for you. Once it has arrived, we confirm your booking to her, she keeps the time exclusively for you and any travel is booked.
  • Private meeting places. Dates take place at your hotel, a residence or a restaurant, never on the street.
  • Discretion. Your details stay with a small team and are never shared.

08Red flags: how international clients avoid scams

International clients are a favourite target for fake profiles and payment scams, because they are far from home and short on time. Watch for these warning signs:

  • Photos that look too perfect. Stolen pictures of models or influencers are common. A reverse image search takes a minute.
  • Pictures without a common thread. A serious agency shoots its ladies in the same recurring locations, which shows that the photos were made for this purpose and are neither AI-generated nor stolen. Videos, private pictures that the ladies share themselves and a team you can reach personally at any time are further good signs.
  • No website, no conditions. Only a phone number in a classified ad, no published rates, no terms.
  • Payment to unknown numbers. Requests for gift cards, cryptocurrency or transfers to private accounts before anyone has confirmed who you are dealing with.
  • Pressure and changing prices. A price that grows after you have paid, or “extra fees” for a driver or security.
  • Anything that suggests a lady is not free. If someone else answers every question for her or she seems afraid, walk away and, if you suspect exploitation, contact the police.

A serious agency asks for a deposit too, but it does so with a confirmed booking, clear conditions and a team you can reach before and during your date.

09Discretion and safety tips for your stay

  • Book through a website you have checked, and keep your communication on one channel.
  • Choose a hotel where your companion can join you without fuss. Most upscale hotels in Madrid, Barcelona and Marbella are used to business travellers who are joined by a companion.
  • Have the agreed amount ready in an envelope, as agreed with the agency. It keeps the moment simple and avoids misunderstandings.
  • Respect the lady’s boundaries. Consent can be given and withdrawn at any time.
  • Keep it private both ways. Do not ask for her personal number or other private details: our ladies want the date to be an adventure that leaves their private life untouched, just as much as you do. Discretion is our highest priority and applies to both sides. Repeat dates are arranged through the agency.

10Booking a high class escort in Spain the right way

The legal picture in Spain is clearer than many clients expect. Meeting a consenting adult companion in private is not a crime. Exploitation, minors and street solicitation are where the law draws hard lines, and a good agency stays far away from all three. Choose an agency that is transparent about who it represents, what it charges and how it protects your privacy, and your date will be what it should be: relaxed, discreet and entirely by mutual choice.

When you are ready, send us your booking request with the city, date and time you have in mind. Our team will answer personally and take care of the rest.

Questions & answers

Are Escorts Legal in Spain? What International Clients Should Know – FAQ

01Are escorts legal in Spain?

Spain does not prohibit adult sex work as such. Meeting a consenting adult companion in a private setting is not a crime for the client or the lady. Coercion, exploitation, anything involving minors and street solicitation in certain places are illegal.

02Is it legal to book an escort agency in Spain as a tourist?

Booking an adult companion's time through an agency is not a criminal offence in Spain. Choose an agency that works with verified adults, publishes its prices and conditions and arranges dates in private places such as your hotel.

03Can I be fined for meeting an escort in Spain?

Fines apply to requesting paid sexual services in public areas near places used by minors or where road safety is at risk, and many cities such as Barcelona and Madrid ban street solicitation. Private dates arranged through an agency are not affected by these rules.

04Is Spain going to ban paying for sex?

The topic is debated politically. A bill to make any brokering of sexual services a criminal offence and to fine clients was rejected by parliament in 2024. The broader abolitionist law was not included in the government's 2026 legislative plan, and with the early general election on 29 November 2026 no new law can be passed before a new parliament is formed. The current rules still apply.

05How do I avoid escort scams in Spain?

Avoid profiles with only a phone number, no published rates and stolen-looking photos, and never pay with gift cards or crypto to unknown numbers. A serious agency confirms your booking, has clear terms and asks for a deposit only once the date is agreed.

06What does the fee for a One Kind date cover?

All fees exclusively cover the companion's time and presence. Any form of intimacy is subject to mutual consent and the companion's individual discretion at all times, as stated in our terms and conditions.
