General Terms and Conditions
One Kind Agency
1. Scope of Application
1.1 These General Terms and Conditions apply to all services offered by One Kind Agency, in particular the arrangement of companions, models, or entertainers for social occasions and private arrangements, hereinafter referred to as “Models”.
1.2 By submitting a booking request, confirming a booking, making a payment, or otherwise using the services of One Kind Agency, the client accepts these General Terms and Conditions in their current valid version.
1.3 Any amendments, side agreements, exceptions, or deviations from these General Terms and Conditions require written confirmation by One Kind Agency.
2. Agency Services
2.1 One Kind Agency acts exclusively as an agency arranging companions for social occasions, dinner dates, events, travel companionship and private meetings
2.2 Any activities beyond social companionship are not part of the contractual service provided by One Kind Agency. Such matters, if they occur, are based solely on mutual consent between the persons involved and fall outside the contractual relationship with the agency.
2.3 One Kind Agency does not guarantee personal chemistry, emotional connection, specific behavior, or any outcome of a meeting. The agency is responsible for the organization and arrangement of the booking, but not for the personal interaction between the client and the Model.
2.4 One Kind Agency may act as an authorized payment recipient on behalf of the Models. The respective Model authorizes One Kind Agency to receive deposits, advance payments, booking fees, travel costs, and other agreed payments from the client in connection with the arranged booking.
2.5 One Kind Agency accepts no liability for the conduct of either the Model or the client during a meeting.
3. Booking Confirmation and Deposit
3.1 A booking is only considered confirmed once One Kind Agency has accepted the booking request and the required deposit or advance payment has been received.
3.2 A deposit or advance payment may be required in particular in the following cases:
- new clients
- bookings made in advance
- bookings outside the Model’s home city
- travel dates
- overnight bookings
- bookings involving travel expenses
- any arrangement requiring the Model to reserve her time exclusively
3.3 The deposit amount is determined individually depending on the booking, the Model, the location, travel requirements, and overall arrangement. Unless otherwise agreed, the minimum deposit is 40% of the agreed fee.
3.4 For certain bookings, One Kind Agency may require a higher deposit, a percentage of the agreed fee, or full advance payment.
3.5 The deposit serves as binding booking security. It compensates the agency for organizational work already performed and ensures that the Model reserves her time exclusively for the client.
4. No Refund Policy
4.1 All deposits, advance payments, booking securities, and payments made to One Kind Agency are generally non-refundable.
4.2 If a confirmed booking is cancelled by the client, the amount already paid will not be refunded.
4.3 Instead, the amount paid may remain as a deposit with One Kind Agency and can be credited toward a future booking within six months from the original payment date.
4.4 After the six-month period has expired, any unused deposit shall be forfeited, unless a different individual arrangement has been confirmed in writing by One Kind Agency.
4.5 Individual goodwill arrangements, extensions, changes, or alternative solutions may be offered by One Kind Agency at its sole discretion. The client has no automatic entitlement to such an arrangement.
4.6 A refund is also excluded if the client changes his mind, cancels the booking, does not appear, refuses the meeting, ends the meeting early, violates the agreed terms, or behaves in a way that makes the arrangement impossible or unreasonable.
4.7 This no-refund policy applies to the extent permitted by applicable law.
5. Cancellation by the Client
5.1 If a confirmed booking is cancelled by the client, the deposit or any advance payment remains with One Kind Agency and may be used as a deposit for a future booking within six months, subject to availability and written confirmation.
5.2 Any travel costs, hotel costs, taxi costs, agency expenses, payment fees, or other costs already incurred must be borne by the client in full and are not refundable.
5.3 If the Model has already travelled, is already on her way to the agreed appointment, or has blocked her time exclusively for the client, One Kind Agency reserves the right to charge the full agreed amount.
5.4 In the case of travel dates, overnight bookings, or arrangements lasting 24 hours or more, cancellation may result in the full agreed fee and all related costs becoming due.
5.5 A postponement to another date may be possible by individual agreement, but only if confirmed in writing by One Kind Agency and subject to the Model’s availability.
6. Cancellation or Changes by One Kind Agency
6.1 In rare cases, a Model may become unavailable due to illness, personal circumstances, travel disruption, safety concerns, force majeure, or other reasons beyond the agency’s control.
6.2 In such cases, One Kind Agency will make reasonable efforts to offer a suitable alternative Model, a rescheduling option, or another appropriate solution.
6.3 If a booking cannot take place as originally planned, the amount already paid may remain as a deposit with One Kind Agency and can be credited toward a future booking within six months.
6.4 The client is not entitled to insist on a specific Model if she is no longer available or does not wish to proceed with the booking.
7. Early Termination of a Date
7.1 If the client ends the appointment early, the agreed fee remains payable in full. No refund or reduction will be granted.
7.2 If the Model ends the appointment early due to inappropriate behavior, lack of hygiene, intoxication, boundary violations, aggressive behavior, disrespect, unsafe circumstances, or any breach of the agreed terms by the client, the full agreed fee remains payable and no refund will be granted.
7.3 If the appointment is terminated within the first 30 minutes due to misconduct or non-compliance by the client, One Kind Agency may retain the full deposit and charge any costs already incurred.
If the appointment is discontinued within the first 30 minutes due to a lack of chemistry, 40% of the applicable 2-hour fee will be charged. Any costs already incurred remain payable in full by the client.
7.4 Any travel costs, hotel costs, taxi costs, or organizational expenses already incurred must always be paid in full by the client.
8. Client Obligations
8.1 The client is required to provide truthful, complete, and accurate information when making a booking.
8.2 This may include, but is not limited to:
- full name
- contact details
- hotel or meeting location
- booking duration
- preferred date and time
- general expectations
- relevant preferences
- information necessary for safety and coordination
8.3 One Kind Agency does not arrange anonymous bookings.
8.4 The client agrees to behave respectfully, discreetly, and appropriately toward the Model and the agency at all times.
8.5 The client must respect the Model’s personal boundaries at all times. Any form of pressure, coercion, disrespect, aggression, unsafe behavior, intoxication, or inappropriate conduct may result in immediate cancellation or termination of the booking without refund.
8.6 The client agrees not to request, pressure, or encourage the Model to meet privately outside the agency or to communicate privately outside the official booking channels.
9. Hygiene and Safety
9.1 The client is required to maintain appropriate hygiene standards before and during the meeting.
9.2 If the Model considers the hygiene conditions unacceptable, unsafe, or uncomfortable, she is entitled to refuse or terminate the meeting.
9.3 In such a case, the full agreed fee remains payable and no refund will be granted.
9.4 One Kind Agency reserves the right to cancel or refuse any booking if there are safety concerns regarding the client, the location, the arrangement, or the circumstances of the meeting.
10. Travel Costs and Additional Expenses
10.1 For bookings outside the Model’s home city, the client must cover all travel-related costs.
10.2 These may include, but are not limited to:
- flights
- train tickets
- taxis
- hotel accommodation
- travel compensation
- administrative fees
- other necessary expenses related to the arrangement
10.3 Travel costs may be estimated in advance and adjusted once the actual costs are confirmed.
10.4 Travel expenses are generally due in advance and are non-refundable once booked or incurred.
10.5 If the booking is cancelled after travel arrangements have been made, the client remains responsible for all costs already incurred.
11. Payment Terms
11.1 Payments may be made by bank transfer, payment link, credit card, or other payment methods accepted by One Kind Agency.
11.2 The remaining balance must be paid no later than at the beginning of the meeting, unless otherwise agreed in writing.
11.3 Payment processing fees, transaction fees, or currency conversion fees may be charged additionally and must be borne by the client.
11.4 A booking is not binding until the required payment has been received and confirmed by One Kind Agency.
12. Discretion and Confidentiality
12.1 Discretion is essential to all arrangements made through One Kind Agency.
12.2 The client agrees not to disclose, publish, forward, record, photograph, film, or otherwise share any private information, images, communication, or personal details relating to the Model or the agency.
12.3 Any unauthorized recording, photographing, filming, publication, sharing of personal data, or violation of privacy is strictly prohibited.
12.4 A breach of confidentiality may result in immediate termination of the booking, refusal of future bookings, and possible legal action.
13. Model Selection and Availability
13.1 All bookings are subject to the availability and personal confirmation of the selected Model.
13.2 One Kind Agency may suggest suitable Models based on the client’s preferences, but the final acceptance of a booking always depends on the Model’s individual decision.
13.3 The client has no entitlement to a specific Model, date, time, or arrangement until the booking has been confirmed by the Model and One Kind Agency and the required payment has been received.
14. Data Protection
14.1 One Kind Agency processes personal data solely for the purpose of handling inquiries, arranging bookings, verifying clients, ensuring safety, processing payments, and complying with applicable legal obligations.
14.2 Client information is treated confidentially and will not be shared unnecessarily with third parties.
14.3 Certain information may be shared with the selected Model where necessary for the preparation, safety, and coordination of the booking.
14.4 Clients may request information about their stored data, request correction or deletion, or object to processing, subject to applicable legal retention obligations.
15. Refusal of Service
15.1 One Kind Agency reserves the right to refuse, cancel, or discontinue any booking at its sole discretion.
15.2 This applies in particular in cases of disrespectful communication, unsafe behavior, boundary violations, unpaid amounts, false information, repeated cancellations, inappropriate requests, or any conduct that does not align with the agency’s standards.
15.3 If service is refused due to the client’s behavior or breach of these terms, no refund will be granted.
16. Severability Clause
16.1 If any provision of these General Terms and Conditions is or becomes invalid, unlawful, or unenforceable, the validity of the remaining provisions shall remain unaffected.
16.2 The invalid provision shall be replaced by a valid provision that comes as close as possible to the intended economic and legal purpose.
17. Acceptance of the General Terms and Conditions
17.1 By confirming a booking with One Kind Agency, submitting payment, or proceeding with the booking process, the client confirms that they have read, understood, and accepted these General Terms and Conditions.
17.2 Acceptance of these General Terms and Conditions applies even without a separate signature, provided that the client proceeds with a booking, payment, or confirmed arrangement.
17.3 If the client has any questions, objections, or uncertainties regarding these General Terms and Conditions, they are required to contact One Kind Agency before confirming the booking or making payment.
17.4 Once the booking has been confirmed and payment has been made, the client is deemed to have accepted these terms in full.
